HOOAH! Judge Rules in Favor of "Fired" Nolensville Police Officer! Welcome Back Officer Holt!

Judge Robert E Lee Davies said
it seems the Mayor and Aldermen
acted in a arbitrary and capricious
manner when they fired Mr. Holt.

Arbitrary means unreasonable,
unsupported and uncontrolled
by law or statute.

Capricious means fickle, erratic,
based on whim and variables.

Holt's attorney said the town did
not follow its own personnel and
grievance policies in firing his
client.

Nolensville Mayor Lothers came up
missing again not being present

when the Judge said---"Town did
not notify Mr. Holt of the reason
for his firing before he was required
to defend himself at the hearing?

Judge said, "I'm not convinced that
Officer Holt knows to this day the

reason why he was fired?"

Mayor & Board lost "big-time" so
now they must give Mr. Holt his
job back with back pay, benefits
and damages for illegal firing!

You are not going to believe what
the Mayor said about this in today's
paper?

"There may be a potential appeal"
by the board after they have looked
at some of the wording in their pol-

icies. She goes on..."it sounds like
the judge had a question of our pro-
cedures manual that we knew there
was some erroneous language that
needed to be cleared up"

You got that right Mayor...the Judge
alluded to arbitrary and capricious
procedures unsupported and based
on
whim and fancy. Mayor said "we
are already on top of some of the
language"? Sorry Mayor too little
and
far too late after the fact that you
based your firing of this officier on
absolutely no correct procedures.

Question Mayor? Where is your $100.

per hour town attorney that sits in the
board meeting and probably said it
was OK to fire Mr. Holt? Also Police
Chief Rigsby what did he base his
decision on to fire Mr. Holt?

Somebody ought to call Mr. Woodruff
and the two maintenance workers who
were all fired? If they act fast enough
they may be able to get their jobs back
before town officials can find out what

is wrong with their procedures?

Don't forget the Mayor said "we are al-
ready on top of some of the language?
Anybody know what this means? Well
some have said..."if they knew long ago

that the procedures were wrong...then
how can they decide to fire Mr. Holt?"

Problem is the Mayor and most of the
board including the town attorney DO
NOT KNOW WHAT IS WRITTEN IN THEIR

OWN PROCEDURES?

Hello town employees! Don't say you
weren't warned! Mayor and Board do
not follow their own policies,

procedures and DUE PROCESS!

Townspeople will remember Alderman
Felts who was censured without due
process. And they tried to do the same
against Alderman Curtsinger but the

town lost and Curtsinger was found to
be totally cleared of all charges by the
Mayor and Board.

QUESTION? IF NOLENSVILLE ELECT-
ION WERE HELD TODAY HOW MANY OF
THE TOWN OFFICIALS WOULD BE VOTED
BACK INTO OFFICE? NOT ONE YOU SAY?
HOW ABOUT ONE OR MAYBE TWO?

TIP! SPRING HILL GOES OVER BUDGET

BY 3 MILLION. NOW AFTER THE STATE
STEPS IN TO MONITOR THEIR BUDGET
PROCEDURES---THEY DECIDE TO HIRE
A FULL TIME 24/7 TOWN MANAGER!


NOLENSVILLE MAYOR AND BOARD
NEED TO HIRE A TOWN MANAGER ASAP!

Judge Davies not only found that the BOMA acted arbitrarily and capriciously--he also found that the hearing on Officer Holt's firing violated both the Town policy and due process.

The judge prefaced his ruling by observing that the Town did not notify Charlie of the reason for his firing before he was required to defend himself at the hearing. He said, "I'm not convinced that Officer Holt knows to this day the reason why he was fired."

It is true that Mayor Lothers was not present in the courtroom when the Judge made his ruling. Nevertheless, it is disingenuous of her to characterize this as simply being the judge's "question" over the wording of the town policy. It appeared to me the judge was not just "questioning" -- he was outraged by the conduct of the BOMA in this matter. That's why he was able to rule quickly on this matter, from the bench, instead of taking the matter under advisement and issuing a written opinion at a later date.

I wonder if the "language change" the BOMA proposes to make is to eliminate the requirement to tell town employees WHY they are being fired?

Williamson Co. Chancery Court Judge R.E. Lee Davies ruled today
(9/17/07) that the Mayor and Board of Aldermen acted in an "arbitrary
and capricious" manner in upholding Holt's discharge.The judge ordered
Board to reinstate Holt with back pay. The judge found that the Board
violated its own personnel policy and due process in the May hearing on
Holt's appeal.

Hello 4:55 PM...you are so right! Change the requirement to tell town employees WHY they are being fired? I remember Police Chief Rigsby saying "He did not have to tell Holt why he is being fired?"
Everybody in town knows why Chief and Officer Holt hated each other and it could not be mentioned in the courtroom. It was a triangle of three people--two men and just
one _____? Yeah you guessed it!

Good reporting 4:55 PM...I didn't know our missing Mayor missed another important meeting in front of the Judge who handed down his opinion. Yeah Mayor this is serious business not "simply" an opinion that you hope to overturn.
Thank you local voters for voting in a trio of totally unqualified people...Lothers/Dugger/Alexander?

We checked with the Tennessee Municipal League and nowhere do they approve of a Mayor missing meetings and failing to communicate with the Board. Not being present in the courtroom as the chief representative of the town when the Judge commented on the outrageous performance of town officials in the firing of Holt is also NOT ACCEPTABLE! Would that we could "recall" this puppet mayor and her puppetmeister--Dugger.

People say Mayor was sick and missed Boma meeting and the court hearing on firing of Officer Holt.
OK let's give her 2 passes! But in her absense Boma became mired in misinformation due to ignorance of board members. Its clear why she wanted to miss the Judge's ruling of the actions of her and board as not following their own policies and due process for firing of Holt.
Wake up Mayor this is a Judge speaking about your unauthorized firing of Officer Holt. It can't get any clearer that you don't know what you are doing--PERIOD!

Doesn't our Mayor claim to be a Christian? Can we say "HYPOCRITE"?! She also was supposed to have all of this extensive knowledge in government. But seems to me that she doesn't know her a-- from a hole in the ground! If she did, she would know that Town Hall's employee policies cannot be changed with out following certain procedures! Also she delegated authority to Chief Rigsby that she was not allowed to delegate to ANYONE! I'm glad I can honestly say that she is NOT my mayor because I seen her true colors the moment I met her and therefore I DID NOT VOTE for Lothers! It is also scary that since she took office, the Town of Nolensville had 3 million dollars in the account and now we have a whopping half million dollars!!! We know that 1.4 million of the money could have been saved if she had not fired Rich Woodruff for not calling in, even though he had a doctor's excuse! Mr. Woodruff was logging everything Nolensville needed for the Rocky Fork Rd project and could have had approval & provision from the County but she let him go and therefore will ask for the money later, provided that they approve! And you only get 1 chance per once a year! And guess what, with all of these law suits that are building because of her, what happens to the Town when all money is gone and the town is bankrupt?! Can you say "Brentwood"?! I can not STRESS enough how glad I am that I did not vote for HER!!! We just need to make sure the rest of the voters know not to vote her into office again, or her lil'sidekick, Dugger.....

Well, lets look at the first and biggest problem. Chief Paul Rigsby, I mean hello I have seen a flat surface thats sharper than this guy. Is it just me or does he have pervert and raciest all wrapped up in one. Trust me listen to him talk sometime, especially when he thinks no one important is around. According to him everyone in town is an idiot in his eyes with the mayor and the council at the top of the list. I say they all need go!!!! Nolensville its time to let your voice be heard.
