12/1/05 Oh Yeah! Ye Ole Town Meeting BOARD OF MAYOR & ALDERMEN
Meeting started promptly at 7 p.m. Mayor,
alderman and many in the audience had
just attended Christmas Tree Lighting at
public library. Merry Christmas to you,too!
Good citizen participation at beginning of
meeting covered various developments.
Comments included pros and cons of
Britian Downs and Silver Stream home
developments.
Mrs. Lillian Marusa, owner of 7149
Nolensville Road presented a brief state-
ment about an unauthorized attempt
by local realtor and prospective buyers to
rezone her property from Suburban
Residential to Commercial. She firmly
stated that at no time did she authorize
this attempted rezoning and that she
wanted the motion cancelled.
Her attorney had circulated a formal
letter to Mayor and Aldermen prior to
the meeting requesting that the rezon-
ing be immediately stopped. Mr. and
Mrs. Michael Taylor, prospective buyers
(represented by A & E Realtors) spoke
about a sales contract on Mrs. Marusa's
property that they were convinced was
valid.
Next to speak was Mr. Armatrudo of
A & E Realtors in Nolensville. He
strongly stated that he had an executable
sales contract by Taylor's to buy the
Marusa property and that he intended to
fulfill it.
Mrs. Marusa visably upset asked to speak
again. She firmly stated that there was no
valid sales contract and that she did not
sign any kind of extension to the original
sales contract.
At this point the town attorney said that the
city should not be involved in a dispute
between private parties over the potential
sale. Despite the fact that in a prior town
hall meeting in November '05 the board
passed (first reading) a rezoning motion
on this property Apparently without check-
ing on who the property owner was and who
requested and paid the fee for rezoning
motion. (Can you say "big gaping loophole
in town hall procedures?") Obviously, this
request should have been rejected and not
be processed by town hall personnel.
Thankfully, many different local citizen-
volunteers heard about it and got involved
(behind the scenes) to immediately take
steps to protect Mr.and Mrs. Marusa.
Nashville's largest legal firm, Bass, Berry &
Sims, prepared a formal letter to Mayor &
Aldermen requesting this rezoning action
be stopped or risk a serious lawsuit.
This citizen group of volunteers working to-
gether with an unbelievable quantity of
e-mails received via our Nolensville Blog
put a plan in place overnite to help the
Marusa's formally cancel any association
with A & E Realtors and then proceed to a
new legitimate sales contract for a future
sale.
Nolensville's citizens can be very proud and
assured that whatever the need there is a
group of very talented people that live here
ready to advise and protect it's citizens.

Mayor's report concentrated on a request by
Nolensville to TDOT for two traffic lights.
One at Clovercroft and another at Sunset.
Request was denied, but Mayor says he won't
give up on the request and is going back to
TDOT to convince them that there is far too
much traffic at both locations to continue
without traffic lights...just too dangerous.
Call or email the Mayor--tell him we need
both lights ASAP!
Public Hearing on Britain Downs develop-
ment by B & Y properties. Citizens spoke
pro and con about the PUD. There were
strong feelings on both sides. One alder-
man pleaded to get developers involved in
needs of town...like school support and new
equipment for fire department. Britain
Downs homes are in the $400,000 price up
...higher roofs and increase in sq. footage.
Potential looks good for Britain Downs to
donate to new school and fire department.
Next items were from parking on new streets
to width of street to allow for emergency
vehicles and yes...new home sprinklers
ordinance was amended to eliminate fee-
based option to opt out of sprinkler systems
for new homes.
New Silver Stream development on some 170
acres with 1/2 acre lots between Rocky Fork
and York Roads. The developer, Mr. Tom
Moon announced he had contracted for a
bridge builder and with road builder. This
would be for a new road off Rocky Fork
around Methodist Church to Nolensville
road. Mr. Moon asked the mayor if he
wanted him to share with everybody news
about county school board contacting
him to consider building new school and
recreation center down Rocky Fork road
east.
This came as a big new surprise to the
mayor, aldermen and everybody in the
meeting. Mayor told Mr. Moon this really
did change things and that the board
would have to consider all of this news
and how it would change plans for the
city.
Before the meeting was adjourned annouce-
ment was made about the Mayor celebrat-
ing his 39th birthday. Mayor responded
by thanking everyone, but said he had to
correct the record that he was closer to
54 years old. Mr. Tom Moon quickly
jumped up and wondered aloud if it would
help his cause if he had a birthday
yesterday.
Most everyone left the meeting in a positive
mood and especially thankful for their
fellow citizens immediately rising to the
need to help Mr. & Mrs. Marusa.
